Imagine, if you will, a place where if you steal and get caught, you only have to return the stolen property, this method only premisses the chances a successful crime will be carried out (not to mention returning the item is, in-part, punishment). Rape, murder, abuse are few of many repulsive acts which would only continue and leave victims to compile in damages: a system of anarchy where no one is invulnerable to being a victim.
In perspective of cons of a system that enacts punishment: it costs money to the general public but recognize what currency is worth in comparison to a system that protects the innocent. (Not saying that any system we have has perfection; sadly, the list of cons continue on as justice systems can often prefer to protect criminals, react on ignorance and/or asses significance in terms of monetary gains. Victims are more victimized and there is no justice, there is only hope for reform or Clint Eastwood to crack down hard on criminals).
A piece of evidence to support this theory today are senior citizens: it is common for elderly individuals who committed a crime to excuse their actions because they feel that the law will not exact punishment upon them (sadly their case is true). Courts have frequently dismissed sexual assault and domestic violence charges only because the prosecuted individual was elderly, even damages have went uncompensated.

What should we do with habitual criminals? Well, I personally feel that habitual criminals should be placed in a different part of the jail or prison and they should have to work. They should have to pay money while they are serving their time or sentence. Why should taxpayers have to pay for criminals? Make the criminals have to work and pay for themselves while their in serving their time. The work should be hard, grinding, tiresome, and exhausting. While criminals are in the system they should get the counseling that is being provided for them. They should have to do group sessions and anger management. I think it should go back to the old ways where the prisoners go out and dig holes, work along side the roadside in chains picking up litter, etc. Where if they stepped out of line or tried to escape they were shot on spot or they were beat down. Or we could just stick them all in a building with gays, leibans, killers, terrorists, drug dealers, child molesters and wipe them off of this earth. So when anyone else would think about it that their would be consequences. It would be a message to the rest of the criminals out there. Whether we do something about it or not in the end they will get it on judgment day in front of God on how they chose to live their lives.
