A company is usually a for profit entity that is in business to represent the best interests of its stakeholders or company owners. A union is a non-profit entity that is organized to represent the best interests of it's membership, which are usually employees of a specific industry trade, and who also can work for many different companies.

In either case it's a matter of legal organization formation, where both entities have to be legally formed and aligned with the laws of both the state and country that support their formation and continued operation.
