That completely depends on your state. If your state has mandatory-sentencing guidelines, those are set so the judge can't use discretion. Some states require jail time (less than a year), and others give probation for such an offense. If your state doesn't have MSG's it depends on the judge. You are best of taking a plea offer and get it reduced to a class B misdemeanor (you should be able to do that as a first time offender) and then only pay a fine and have some unsupervised probation.
