You must live (have a tax home) and work and have foreign earned income. A U.S. citizen or a U.S. resident alien who is physically present in a foreign country or countries for at least 330 full days during any period of 12 consecutive months. To qualify for either of the exclusions or the deduction, you must have a tax home in a foreign country and earn income from personal services performed in a foreign country. These rules are explained in chapter 4 of the Publication 54. Requirements To claim the foreign earned income exclusion, the foreign housing exclusion, or the foreign housing deduction, you must meet all three of the following requirements. 1. Your tax home must be in a foreign country. 2. You must have foreign earned income. 3. You must be either: A. A U.S. citizen who is a bona fide resident of a foreign country or countries for an uninterrupted period that includes an entire tax year, B. A U.S. resident alien who is a citizen or national of a country with which the United States has an income tax treaty in effect and who is a bona fide resident of a foreign country or countries for an uninterrupted period that includes an entire tax year, or C. A U.S. citizen or a U.S. resident alien who is physically present in a foreign country or countries for at least 330 full days during any period of 12 consecutive months. Well depending upon which country you are from foreign art would be technically any art that is not from your country. If you live in the U.S. then you Bernini would be a foreign artist (Renaissance period Italian sculptor). If you live out of the U.S. then Claes Oldenburg would qualify.
