You need legal representation. If you can't afford one, the state which is prosecuting your case is required to provide you with an attorney.
You would if the police thought it was yours!
If the investigators can prove you stole it, you can be charged and convicted.
You will need to get a lawyer for a legally current and correct answer.
In Baltimore, Maryland when you have a gun in your possession you can get in trouble, unless it is registered to you. If you have a gun in your possession and it is not yours, you can be charged, fined, and even given jail time. Depending on if you have a background or not, how lenient they would be with you.
Strictly speaking, it's neither, but I know that's not what you meant. Owning or possessing a gun that is actually stolen CAN be a felony, however, it isn't always a crime. If you find out you have a stolen gun, you can, in most cases, turn it in to the local police without being charged with anything.Added: The biggest factor is if you KNOW that it IS stolen, or SUSPECT that it MIGHT be stolen. If you do not eliminate the doubt and confirm its legality you could be charged with Receiving Stolen Property.
tell them the truth, don't lie and make it worse.
what gun are we talking about here
Get a lawyerAdded: Not enough information is given on which to base an answer or opinion. HOW did they associate your BF with the gun? When they found the gun were his fingerprints on it? Did the pursuing officers SEE your BF throw the gun down but he got away, avoided arrest, and wasn't caught until months later? What was the offense he was charged with?ALL these questions have a bearing on how, and why, he was charged. If the prosecutor is moving forward with the charge it most likely IS legitimate or they wouldn't risk having it thrown out, or dismissed, by the court.
you over charged it
Yes, despite if they are yours or not you can be charged - you can check with your local laws pertaining to felonies but most carry as prohibition on weapons & drugs.
Either you have a defect in the gun/canister or you havn't charged your canister. If you just got your gun you should charge it. Usually they do not come with air in them.
Yours!
