The 6th Amendment to the United States Constitution lays out basic rights of the accused during a federal criminal prosecution. The 14th Amendment and court decisions have applied the 6th amendment protections to the States as well. During a criminal trial, the accused has the right to (1) a speedy trial, (2) an impartial jury, (3) notice of the charges, (4) the right to confront his/her accuser (5) the right to provide their own witnesses and (6) the right to an attorney during the trial. The right to a speedy trial means that a prosecutor cannot intentionally delay a trial for their own advantage. If a court delays a trial for too long it could be unfavorable for the defendant. Remember, defendants are presumed to be innocent until they are proven guilty. So, the constitution limits the amount of time for a trial under a reasonableness standard. There is no specific time limit for the length of a trial. The accused has a right to a jury trial in "serious crimes" that usually are penalized for by more than 6 months in jail. The accused has a right in all criminal cases to be informed of the charges against them and they have the right to confront their accuser. This means that the defendant has the right to be present while witnesses against them are being questioned and they are able to ask them questions as well (cross-examine). The defendant also has the right to provide their own witnesses with which they will have the ability to raise a defense to the accusations. Finally they have a right to an attorney during any "adversary proceedings." This essentially means that as soon as a police officer begins to question a suspect, they have the right to representation by an attorney. This right lasts through the entire criminal process through the end of trial. Once a defendant reaches trial, if they cannot afford an attorney, the court will appoint one for them.

The Sixth Amendment reads:

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

In the world today, though, the protections of the Sixth Amendment are being chipped away in cases involving charges of terrorism. The Sixth Amendment does not apply to prisoners at Guantanamo Bay ("Gitmo"), because it is outside the United States. The government has also claimed the right to use secret evidence in some terrorism cases.
