Best Answer

There are four cards that are greater than a 10 in a ten of cards. Jacks, Queens, Kings, and Aces. There are 4 colors, Spades, Hearts, Diamonds, and Clubs. Hence there are 16 cards that are greater than 10. Any one of the 16 is greater than 10. So the probability that a card you pick is greater than 10 is 16/52 = 4/13

Can you sue a restaurant for overcharging your credit card?

Well, your damages are only equal to the amount of the overcharge. You can probably take care of the error by filing a dispute for the amount of the overcharge directly with your credit card company. It is unlikely that you have grounds for a lawsuit. The legal costs would be greater than the overcharge.
