The logic behind this is that while US Flag represents the entire country, and is a symbol of those ideals which embody the American Nation, one of those ideals is freedom of expression. Freedom of expression includes the right to use symbols in any manner one desires, including symbols that others might hold in reverence. It's a nice irony, that by abusing the flag in an attempt to discount or devalue what it stands for, a person actually re-affirms its meaning.

The only difference in this and other laws is that it can or can not be followed willingly. There are no penalties for not following it, but it is still a violation of national code.
