Anita Hill's allegation that Thomas was guilty of sexual harassment and had created a hostile work environment when he supervised her at the EEOC lead to a Senate Judiciary Committee hearing during Justice Thomas' appointment process. Two other women made similar statements about Thomas off the record, but refused to testify before Congress.

As a result, the Judiciary Committee was unable to agree on their recommendation to the Senate, so Thomas' vote went to the floor without the Committee's blessing. On October 15, 1991, Justice Thomas received confirmation by the narrowest margin in nearly a century, 52-48, just one vote more than the simple majority needed for approval.
