Legally, to bring the charges of infanticide (killing of an infant or newborn) it is necessary to show that the concerned child was born alive. But still question might arise was the child alive after the birth? The answer is tried to be answered by taking the help of concept of age of viability. If there are sufficient advanced medical facilities available at the birth centre, non-viable child can be supported to survive and even a viable child may die soon after birth if there are no such advanced medical facilities at that birth centre. Most of the medico legal experts across the world accept the age of viability as 210 days or 28 weeks or 7 lunar month from the date of fertilization.
