Draco Malfoy didn't intend to actually duel Harry, he was using it as a rouse to get Harry out of bed after hours. Draco then told the caretaker, Argus Filch, so that he could catch Harry out of bed. Draco had hoped that this would result in Harry being expelled.

***Small Spoiler*** In the 7th book Helena Ravenclaw (Rowena Ravenclaw's daughter's ghost) told Harry that the Bloody Baron always loved her and when she ran away he went out to seek her, and he was always hot headed, so, jealous of her freedom among other things, he killed her, then seeing what he had done he killed himself. NOW, DON'T YOU THINK THAT'S PROOF ENOUGH FOR HIM TO BE IN SLYTHERIN!!!!!
Well seeing as too how Tom Riddle's diary, Maevolo Gaunt's ring, and Salazar Slytherin's locket are destroyed in the second book (diary), between the time of the fifth and sixth books (ring), and in the seventh book (locket during the first part). There should be four horcruxes to be destroyed in Harry Potter and the Deathly Hallows part two. those being Helga Hufflepuff's goblet, Rowena Ravenclaw's diadem, Nagini (Voldemorts pet snake), and of course Harry Potter himself.
