The FDA is an agency of the Dept. of Health and Human Health Services. It is one of the U.S. Federal Executive Departments. The FDA is led by a Commissioner of Food and Drugs, and is appointed by the President, with the advice and consent of the Senate. The FDA is responsible for protecting and promoting public health through regulation and supervision of food safety, tobacco products, dietary supplements, prescription and "over the counter" medications, vaccines, bio-pharmaceuticals, blood transfusions, medical devices, electromagnetic radiation emitting devices, veterinary products, and cosmetics.
The FDA falls under the Department of Health and Human Services under the Executive Branch.

All of them dependent on how these clubs act. The Executive can investigate and arrest them if they violate a law, Congress can pass laws against them IF it is in the national interest, and Judges can convict them if they violate some law. To expand on this, the FDA (an executive branch of government) has taken some interest in, and regulation over organic qualifications, claims, etc.
The US supreme court is the branch of the government that regulates disputes between the states. The US Supreme Court is often called the Highest Court in the land.
