He didn't. He resigned his commission as a colonel in the United States army and offered his service to the Virginia State Forces. He worked as a Military advisor and commanded a small army in modern-day West Virginia. In 1862, Confederate President Jefferson Davis placed him in command of the Confederate Army operating in eastern Virginia, which Lee would soon reorganize and rename the Army of Northern Virginia.

Northern forces of the Army of the Potomac were sent to not allow that to happen. By strictly chance the two opposing armies met at Gettysburg, Pennsylvania.
