That is a good moral concern and I agree with you. I would say that the Federal Gov. wants the State Gov. to do things their way and their way is to not put a civilian in a position of executive power and make those "executive" decisions. They are prosecuted by the state because the Fed wants it that way.

The "state" (to include the federal government) prosecutes criminal acts because crime is considered to be an offense against all persons living in it, not just one single person. It is in society's best interest that its citizens be allowed to live life in peace and safety knowing that the whims of one individual do not determine whether or not criminals are allowed to remain at large, dependent solely on whether their victim wishes to prosecute them or not. Additionally, it has NOTHING whatsoever, to do with the federal governments interactions with the states. Our system of criminal justice is descended (believe it or not) from the ancient Roman system and over the centuries has evolved to a point where every civilized country on the globe operates its criminal justice system in the same manner, not just the U.S.

Under a sole criminal view, Congress and the Legislature can pass criminal laws; the executive can arrest for their violation and the Judicial branch can prosecute IF "we the people" indict through a grand jury, and then convict through a jury.
