John Spencer had the great misfortune of serving in the cabinet of John Tyler, who assumed the Presidency in 1841 upon the death of William Henry Harrison. Harrison expired just a few weeks into his first term. Congress had a bitter and contentious relationship with Tyler. He was generally unpopular, and often referred to as "His Accidency," (a play on "His Excellency") by his detractors.

President Tyler holds the historical record for the most Supreme Court nominee Senate rejections, at eight (five men, nominated a total of nine times). Only one of his candidates, Samuel Nelson, was confirmed.

John Spencer served under Tyler first as Secretary of War, then as Secretary of the Treasury, where he advanced some unpopular policies and ended one year with the United States owing more money than it took in. Spencer was seen as a close ally of Tyler, drawing opposition from his own Whig party because they distrusted any friend of the President's. Spencer was also one of the few northerners in a government then dominated by Southern interests.

On a personal basis, he was criticized for getting bogged down in details, and failing to see the larger picture. He also had a reputation for a fierce temper, which tended to alienate people.

Spencer's nomination was advanced twice, once in January 1844, where it was defeated by a vote of 21-26, and once in June, when it was tabled (essentially, ignored), and eventually withdrawn.
