A person who owns property with another by virtue of a survivorship deed cannot leave their interest in the property by their will. When they die the ownership passes automatically to the other joint owner with no need of probate. The deed controls.
Yes, you can show survivorship in several ways: tenants by the entirety, joint tenants, and joint tenants with right of survivorship (required in some states). Some deeds even say, "... grant to X and Y, husband and wife, as joint tenants with right of survivorship and not as tenants in common," in case there was any room for doubt.Unless your local laws say otherwise, "joint tenant" is all you need to say, as it implies the undivided joint interest between the named parties and the agreement that the last surviving member of the list acquires the full remaining property at that time.Caveat:Deeds should always be drafted by a professional who is familiar with the laws in your jurisdiction. Errors made by non-professionals can be costly to correct if they can be corrected. The parties must discuss their needs with an attorney who will then explain their options and draft a proper deed.
should any one court be given the final word
I'm not sure what exactly this is supposed to mean. Obviously you can name anybody you want in your will, and just as obviously if you're the owner of a property you can say "heck with making them wait till I'm dead, I'll list them on the deed now," meaning the answer is trivially yes, this certainly can happen.
Khush-aam-deed
well it does say the final chapter.....so maybe or maybe not...who knows??
You need to reword your question. Do three people own the house as joint tenants or is it the fiance's house? You said the other two want to buy out the woman's share and then you said her fiance refused to sign the deed. What exactly are you trying to say? Use names to describe the situation.
