Only in some cases of an extreme medical condition and with a medical recommendation and approval by the authorities can marihuana/ganja be acquired legally. The fact that maybe some people are let go when in possession of small amounts of the drug does not mean the legality of it, but simply that it costs more money to prosecute such a tiny offender than to simply give them a warning or the proverbial " slap on the wrist".
