Yes it is legal. BUT you have to have 1,000 hours documented experience with a primate, fill out a husbandry form (what they eat, size when mature, caging requirements, vet, USDA source of monkey, etc), 2 letters of recomendation from persons knowing you have the experience and one of those people must be licensed, as well as an application for a Class III permit with the Florida Fish & Wildlife office. (Capuchins are class III animals, but require the experience of class II animals Smae for Spider monkeys). The permit if free. The caging requirements are a cage minimum of 6ftx6ftx6ft, with double door entry to prevent escape, though I recommend at least double that. Cage must have a nest box, manipulative toys, and other items to prevent boredom.

YES....but depending on the species, and permits are required. Permits are issued by the Florida Fish and Wildlife (www.myfwc.com click on licenses/permits for detailed info). FWC divides animals into 3 classes. Class I animals (lions, tigers, bears, chimpanzees elephants, etc) can not be kept as pets. They require 5 acres of land, experience, husbandry forms, contingency plans, insurance or bond, and a buffer zone for some species. Class II animals (macaques, cougars, lynx, serval, wolves/wolf-dog hybrid) can be kept for pets, but the following criteria must be met: 1) 2.5 acres of land, species specific caging, a husbandry form, emergency plan, 2 letters of recomendation(1 from other licesned person), and 1,000 hours of experience with the species or 100 hours and the taking of a test. Class III animals (squirrel monkeys, marmosets, tamarins, etc) don't require experience, but still require the husbandry form, and species specific caging. In Florida you can own a monkey, however you need to call Miami city hall and ask if they have outlawed them in the city limits. If they are legal in the city you will need a permit from the state. Depending on the type of primate you may or may not be able to get the permit. Like if you wanted a Chimp or a monkey called a Gibbon they would deny you, but for a smaller monkey like a Capuchin you would need whats called a Level 3 permit. Contact you state and city for more information. Please consider buying two monkeys, I know it may seem like a lot but they really need the interaction with other monkeys like them. Not only will obtaining two monkeys be beneficial for them, but also for you because you could leave them alone with each other for a little bit, where as if it was a single monkey it would need attention pretty much 24/7. If you are getting a pet primates, please do your research on them. I fully agree on having them as pets but some states have outlawed them and or you need a permit to have them.
