Background Checks

Background Checks are used for everything from employment to rental housing (Senior Citizens; Assisted Living; Section 8 Housing). A Background Check typically includes Social Security Number, Citizenship Status, criminal, commercial, and financial records and range from minimal sensitivity (such as employment for a minimum wage job) to high (such as a job related to the FBI or National Security). It may include property and driving records, drug testing, evaluations for Medical, Mental, and Physiological examinations, polygraphs and arrests/ imprisonment. Typically, a person cannot refuse a Background Check unless you wish to forfeit what you desire, e.g. that housing, that employment. Reasons for BCs include to verify personal information, personal honesty and integrity, exclude drug users, and general risk management.

Other searches such as sex offender registry, credential verification, reference checks, credit reports and patriot act, searches are becoming increasingly common. Does a local ordinance violation show up on a background check?

I did check with my attorney and he said local law ordinance violations do not show on background check.

--

This is generally true. Ordinance violations are generally held in municipal courts which are virtually impossible to search in most cases because there are so many of them and they do not put records online or in any valuable database. That being said, it depends on the type of background check that is being done. The reporting laws in the state in question come into play. Also how the state houses ordinance violations is a key factor.

At the end of the day, you will most likely never see a ordinance violation show up on a background check, but also, never say never.

The best course of action is to self disclose all convictions on your job application so you cannot be disqualified from that job because of omitting something minor that the employer would not care about anyway.

What criminal background checks disqualify a nurse?

Answer

It's not the check that disqualifies, but the underlying action. For example; if patients mysteriously died while in your care, that is not the fault of the background check.

I would say that that which would disqualify a nurse is the same as would disqualify anyone except that nurses have the opportunity to do more harm than say, a burger flipper.

If I were hiring a nurse, I would be very concerned about drug use and abuse.

Answer

Actually, most local laws forbid convicted felons from registering to be a nurse. You can complete the schooling. But not work in health care. However, laws vary from state to state, county to county, and town to town.

How far back does the state of Georgia go on background checks for teachers?

I don't know about Georgia specifically, but usually states look for any felony records no matter how far back and misdemeanors for seven years unless the misdemeanor was a crime against a child. A felony child molestation, for example could be reduced to a misdemeanor lewd conduct.

How does the government perform a background check for a security clearance?

It depends on the clearance. If it is a sensitive clearance, they will ask you for your previous addresses, references, etc. The investigator will typically talk to your references, and get additional names of people who know you.

THOSE people will be interviewed about your character, etc.

These days they are also going to probably dig into your internet history, and look for "who you are" online.

They are going to be interested in two things:

1) You general character.

2) Anything in your background that might, if discovered by an adversary, be used to blackmail you into revealing information.

It is rare that someone approaches "the other side" and offers up the farm. Usually it starts with an innocent approach by the other side for a very small, seemingly harmless bit of information. If there is blackmail involved, the consequences of the blackmail are usually far more damanging in the person's mind than the inconsequential information being asked - maybe just a phone listing that is marked "For Official Use Only" - often information that you would "know" the other side already has anyway - no harm done.

But once the line is crossed, you have committed a crime, and that becomes leverage for more and more demands. They are also usually accompanied by offers of payment, so there is a hook as well as a reward.

That is why the background investigation is interested in finding any compromising information - because it can be used as that first hook in recruiting a long-term spy.

When an employer is deciding whether to use background checks of job applicants who may be affected by that decision?

Usually all new hires from that point forward, but I have done work for companies which, because of a new contract they received have to do background checks on existing personnel.

Remember that anyone can do a background check on anyone anytime they feel like it. It's how you use it that the law is interested in. In the case of existing employees an employer would have to get their permission to conduct and use a background check, unless the consent form that they signed when they were hired included future checks.

An employer could tell an employee that he/she needs to sign the consent to be background checked otherwise you can't work for this client hence they may not be able to continue working there.

This is why I advise employers to use a consent form that covers them now and in the future.

Can an employer do a background check after you have been hired and on the company insurance?

In many cases, yes. But it will depend on the nature of your contract and also your state/countries employment laws.

If you are out on bond and trying to get a good job will background checks show that you have been charged but not yet convicted of a felony?

In most cases, even a felony conviction will not necessarily prevent you from getting a job. However, it sounds like your mind is in the right train of thought to get the background check prepared before the charges are. Be honest with your employer-to-be about your situation so when any blemishes arrise in your background check, there are no surprises. Good luck!

Does the DMV do background checks for state ID applications?

It would not be necessary for a DMV to do a separate 'background check' of the applicant, due to the fact that an applicant must supply valid indentication to receive a state ID. When that information is entered into the DMV system it will in all likelihood indicate whether there are any issues such as outstanding warrants, that would prevent the person from obtaining a valid state ID.
