^^They are not 'technically' firearms. They are firearms. They fire a .177 round (pellet or BB), and a shot to the eye can be fatal if at close range.

A firearm has to be registered (usually on the receiver or bolt) as a firearm in the United States. Under guidelines by federal regulation, only registered FFL's can commercially distribute "guns" to customers. This process through an FFL includes age of 18+ for long guns, 21+ for handguns, and a background check through the FBI database for felony charges. When buying a "bb gun," you do not have to run a background check; you can be a convicted felon; and there is no registered firearm serial number for such item. If one uses such an item in a crime with intent to make another individual feel that it is a real firearm, all legal charges apply as though it IS a firearm.
A "gun" must have a chamber where a combustion explosion occurs in propelling a projectile forward. Some "bb guns" may have such chambers, but there is no combustion explosion occurring.
This is not say that they are not dangerous. Many people die every year in the United States due to improper usage of less dangerous air rifles. Keep in mind, they are not toys and can cause serious injury and/or death.
