Yes, there was a successful case in August of 2016.
After the death of 23 year old Ty Hernandez, his parents found out he had died from fentanyl toxicity. They had no idea he had been using drugs. They tracked down their son's dealer through a series of text messages the two had exchanges.
An undercover officer then purchased drugs from the dealer, and had a recorded conversation about Ty's death. The dealer, Christopher Massena, laughed and said overdoses are good, because they prove the drugs are strong.
A grand jury has found Massena guilty, and he could face up to 100 years in prison due to all the related charges. This case sets a precedent for more charges against dealers due to drug related harm.
It is doubtful that you would be charged on the word of the dealer alone, but it could cause them to do farther investigation into whether you actually did buy the drugs.
You could be charged with manslaughter.
Simple possession is not. However being charged with having a "distribution quantity" of drugs is - you are being charged as a dealer.
a drug fein is someone a drug dealer sells drugs to all the time
i believe if no one else is in the car at the time except you, then you will be charged, but if there are multiple people in the car and you own the car and someone has the drugs and stash them someone, in most cases whereever it is found by that's who is charged, say the passenger stashes the drugs under their seat, the passenger would be charged but if you knew he had the drugs and the officer finds it, then both parties would be charged, with , withholding drugs whether it was yours or not, but it depends on the officer, whether they're more understanding, and find more evidence to lead to a direct source, i believe The driver of a vehicle is responsible for all things in the vehicle and all things the vehicle does. The owner is also responsible.
Buying drugs is not a felony. Selling drugs is a felony. When you buy drugs you would be charged with possession of an illegal substance; which is a misdemenor. If you are buying drugs to sell or give to others then it is a felony.
If they were in possession then that's clear as far as the law see its. It does not matter if its your drugs or someone elses - they were carrying.
Date someone else I agree with date someone else. Don't go with if the guy you are dating is a dealer (you could get charged with being party to a crime). If the person you are dating is riding in your car with drugs, you could also get in trouble for that. I'd tell him to keep the stuff far away from you if you don't want to get in legal trouble. * Nothing, if you are involved with a drug user, you have knowledge of such and therefore are guilty by complicity .
* Put a bomb into them and drop them in a building. * Put drugs in them. * Use them to cut someone's neck or any murder. *
yes....buying/selling drugs is illegal no matter who you purchase them for or who's money you use....In some states if you purchase drugs for someone else with money that they gave you its possible you could be charged with the more serious crime of Drug Trafficking....
A drug dealer
Questioner does not give his state, so I don't specifically know what that penal code number is, but if the officer saw the drugs 'in your hand', you can be charged with their possession.
