They aren't going to go to jail for dating, but they could go to jail for any sort of sexual contact. And if the younger one get ticked off at the older one, they could make claims that could cause all sorts of problems. It isn't worth the risk. Wait until the younger one is at least 16, which is legal in most states, but not all.
