Unknown. 'Unofficial' meetings before the trial between the disagreeing parties, in an effort to work out their difficulties, might well be tried in the majority of civil cases. But there are no statistics kept of "non-court-ordered" aribtration. Therefore - it is only AFTER the suit is formally filed that the court can order aribtration in an attempt to head off a full-blown trial. It is only in THESE instances that statistics can be kept.

Can a civil suit change to arbitration?

It is possible that a civil suit could be either voluntarily dismissed without prejudice to being reinstated or put on hold at the request of the parties and with consent of the court in order to permit the parties to have the matter resolved through arbitration. In addition many courts now have some form of pre-trial non-binding alternative dispute resolution processes.

What is the difference between Rights arbitration and interest arbitration?

Rights Arbitration - This term is used in the context of disputes arising out of existing agreements. Therefore, rights arbitration involves interpretation of existing contract terms.Interest Arbitration - This term is used when disputes arise and there is no agreement. As per the book - Labor Relations and Collective Bargaining by Carrell and Heavrin (7th Edition, Prentice Hall), Rights arbitration is found in almost every labor agreement today and is used far more today than interest arbitration. Because interest arbitration tends to have a broader scope than rights arbitration, many unresolved issues are present in interest arbitration.
