In the US, to "engage in the business" of buying and selling guns, you need a Federal Firearms License. Those are issued by the Federal BATFE, and DO require a background check. Several states also license dealers in addition to the Federal license. An employee of a dealer will also have a bakground check.

You simply need to be 18 or older, be able to pass an NICS background check, have valid identification, and be a resident of Florida or a state which a Florida gun shop can sell a firearm to.

If you buy it from a gun store then always, the federal law requires all gun stores to have back ground checks. If you buy it from a private person like from an add or a small yard sell or something were it is a person selling a gun and not a business then it depends on state law. Some states require people who want to sell there guns to give a background check to people purchasing it.
I guess so. If you fail the background check, they cannot return it to you and they cannot let anyone redeem a firearm that was pawned by someone else.
