At present, federal law requires the Supreme Court to seat nine justices, although there are sometimes vacancies that temporarily reduce the number to eight or fewer.

Congress determines the number of justices needed based on caseload (and sometimes to manipulate the political environment). The statutory size of the Court has ranged from five justices to ten at various points in history, although the legislation requiring only five justices was repealed before a vacancy occurred, and Court only met only once with ten justices before that legislation was repealed.

Congress set the size of the Court at nine in the Judiciary Act of 1869, and the number has remained unchanged since that time.
