No, because he is not overage. If he was 18 it would be considered statitory rape whether the female gave permission to have sex or not.

If you live in the US… It's a common misconception that a minor can't be charged with statutory rape. A minor can be charged with statutory rape. 14 is below the age of sexual consent in every state. In all likelihood this will get reported (certain persons such as teachers, doctors, etc are mandated reporters). It does not matter at all if the parent's 'don't care' because they don't have the power to forgive someone for breaking the law. Boyfriend needs to talk to an attorney.
