If none of the two partners are infected, then there can be no transmission. If one of them is infected, he can transmit it to the other. If both are infected... well, then it probably doesn't matter much if you get a few additional germs.

It depends, if your partner has active HIV virus then yes you could potentially get HIV or AIDS from *ANY* body fluid. So think sweat, saliva, blood, etc.
