In the UK at least it would appear that there is additional legislation that COULD mean that using Facebook when you are under 13 is illegal and could result in prosecution. Further, your parents COULD be liable for allowing you to use Facebook as well.
The legislation in question is the Misuse of Computers Act 1990 which makes it an offence to gain (or to enable) unauthorised access to computer material.
Using Facebook under the age of 13 is against their terms and conditions, which makes any such access "unauthorised" and therefore illegal under the Act.
Allowing children under 13 to use Facebook could be termed "enabling" and expose parents to similar criminal liability.
