It's not "illegal," in the sense that it is not a criminal/civil offense for a person under 13 year old to join, however it is advised by Facebook. The Terms of Service state that you must be 13 or older to join. If Facebook somehow finds out you are under 13, they will immediately terminate your service and delete your page, no questions asked.
Also, according to Time Magazine, accounts with anyphotos of children under 13 are also deleted, no matter whether it is your son, kid sister or grandchild.
That all said, there's (likely) no issue of illegalitythat would arise from a person under 13 using the site, all other things being equal (and legal). I.e., there are no laws/statutes against a 13 year old using Facebook or other online social networks, aside from "adult-themed/pornographic" websites.
However, should a person do something like post pictures of children under 13 of an illegal nature, state and Federal law can (and will) intervene.
In Addition:
The US Federal Trade Commission's Children's Online Privacy Protection Act (COPPA) basically says that any web site operator collecting personal information from children under the age of 13 must have verifiable parental permission. Some web sites, such as Facebook, have chosen to disallow underage children from using their services due to all that is involved in gaining that parental permission plus the fact that their web site is not directed at children under the age of 13.
