It depends. To begin with, the answer will differ according to what country the crime was committed in. For the United States, there are number of different possibilities depending on who is involved and how the crime is committed.

Most often, murder would be tried in a state criminal court, but if the defendant is a juvenile, it may be tried in juvenile court; if the defendant is in the military, it may be tried in a military court. If the victim is any of a number of government officials, it becomes a federal case. In this instance, or if the crime was committed as part of another federal crime, the case would appear before a federal court.

I'm not a lawyer, so I've probably left out most of the possible complications.

Typically murder trials must take place at the circuit level or higher. Some states require a Grand Jury for trial of murder suspects. New York State tries capital crimes in Superior court.

Will you ever see a murder trial in the US Supreme Court?

No. The US Supreme Court only exercises appellate jurisdiction over criminal cases originating in the state and federal court systems; they do not hold trials. The federal court of original jurisdiction (trial court) for a murder case would be the US District Court overseeing the territory in which the crime occurred.

What kind of questions do you ask in a murder trial?

If you are in a murder trial, you would probably ask like where they were on the night of the murder, did you see anyone else commit the murder, things like that.

Why do you have a court hierarchy?

žHaving a court hierarchy gives people the ability to appeal to a higher court, if you felt the trial had been unfair.žIt also provides efficient distribution of resources and specialisation. Meaning would all cases have an ability to be heard on the one day. Suppose there is a case about some stolen DVD's, and another case about a murder, the murder case would have to wait because the stolen DVD case would have been booked in first.žAnother reason for court hierarchy would be you will get a magistrate that would be dealing with similar cases, thus giving an effective punishment than a magistrate who had been dealing with a murder trial.

What court would hear a murder case first?

It depends on what the crime is, it usually is heard in the magistrates court to see if there is enough evidence held against the offender. then the crime case will be taken to another court room. A murder case would most likely be heard in a state trial court, since the states are primarily responsible for prosecuting crimes within their border. It would be less likely to be in a federal trial court, because there is no federal statute prohibiting a straight murder charge. When murders are prosecuted in federal courts, there must be some federal aspect to it, such as crossing state lines to do it or doing it in order to deprive someone of their civil rights under federal law. In any event, even if there is some federal aspect to it, the state would still have jurisdiction to try the murder case.

Where did the Romans hold a trail?

The location of the trial depended on the crime and the status of the people accused. A treason trial, a public misconduct trial, or even a murder trial by high profile people would be held in the senate. Lesser crimes were tried before the city praetors. The crime of murder had its own court also heard by a praetor. A petty crime, or complaint could even be settled by an aedile.

How does jail affect minors who have committed murder?

He/she would face the same punishment as a normal person, prison for like 120 years.Added; For a crime that serious, the court would probably move the case from juvenile court to adult court for trial as an adult offender.

What is a media trial as opposed to a court trial?

What an excellent question. A court trial is a step in our guaranteed right to due process in a criminal case. Each state has a step by step procedure in place to comply with this Constitutional guarantee. It is a trial held to determine the guilt or innocence of the accused with evidence and testimony that has been accepted by the court to present in the case.A media trial is not an actual trial, it is a term used to describe the tendency of the media to decide the guilt or innocence of an accused based on whatever they decide is evidence, whether it would be acceptable in a court of law or not. A media trial also includes a great deal of opinion on the part of the media participants.

If a person commits a murder then commits suicide are they still charged with the crime of murder?

Tried for murderNo, because you can't charge a dead person. That would be a waste of the court's time to spend tax dollars charging a dead person with a crime. They wouldn't charge a suicide victim with murder any more than they would charge a dead person with murdering someone else.More accurately, it is because the killer would be unable to appear at trial. Imagine that the killer did not commit suicide, but fled the country. A trial could not be conducted in his absence. He would have to be located first and then tried.

In the Roman Empire what would happen to someone that committed murder?
