∙ 9y agoIt is because he was the first person to introduce a new method to the way crime and punishment were viewed and administered, essentially reforming the justice system that prevailed till then which was a mixture of judicial action, vigilante justice and heinous torture. Many theorists and theories have been developed since then, but Cesare Becarria was the first to critically analyse crime and punishment then publish works arguing against the current system. He believed that the methods of torture to punish criminals were barbaric and uncivilised and wrote a paper describing how he thought criminals should be dealt with in relation to punishment. His 3 key elements were that punishment would be certain, swift and proportional in severity. This would (mostly) eliminate corrupt judges and judgements that favoured the wealthy and well connected, ensure that punishment would be delivered to ANYONE that committed crime and the punishment would fit the crime and not be over the top eg cutting off the hand of a person who stole a loaf of bread, but still be enough to deter the criminal and anyone else from thinking of doing the same thing, lastly that it be carried out immediately.
His beliefs focussed on improving the criminal justice system and that everybody was rational and had freewill to make the choice of crime.
