They are often passed by being innocently kissed by some one that has them. The second most common way to get herpes is through having intercourse with a partner that is infected with herpes.
You can also get herpes by receiving oral sex. If you receive oral sex from some one that has a viible cold sore.
There is also a small chance of getting oral herpes from sharing things like cups or utensils with soem one that has a visible cold sore.

To become pregnant, both parties must be "fertile" at the time of intercourse. To acquire an STD, there must be skin-to-skin contact with an infected person. For example, a person may have genital warts but if both persons keep their clothes on and do not have any unprotected skin-to-skin contact, the uninfected person will not become infected.
