i would think that, at least in my state of Tennessee, that car A would be At Fault; however, given that car B had its lights off (doesn't matter what color it is, i see why you would mention black at night though), the police may determine that as a contributing factor to the accident, but turning left in front of a car (green or yellow light) puts the accident at car A's fault.. unless the police (and insurance companies) deem that the contributing factor (being the lights not turned on) was significant enough to be the sole cause of car A turning left , unable to see the car.. did you not call the police when the accident happened? they probably would have assumed a no-fault accident, or faulted A with the accident and given B a ticket for no lights on.. (failure to exercise care, in both situations).. but that's tennessee, i dunno ANOTHER PERSPECTIVE: 'A' probably should have stopped on the amber light. However, at night, in the dark and without being able to see any approaching traffic (unlit car) he could not have known he did not have the right-of-way and therefore made the legal left turn. The fact that he was struck (1) by an auto that was unlit, and (2) had to have run an amber light itself and (3) apparently made no effort to yield to the clearly turning (and lit) vehicle in front of him - places the burden of the collision squarely on 'B.' That's my perspective from 30 years of having investigated collisions of all types.
