He has not yet been charged, because the case is still under investigation. He has returned to duty, but he is under constant supervision. One of the people assigned to his detail is an actual military investigator. He is under constant scrutiny at the moment. A charge still may yet come, but the military has to examine all sides, and then build a case if they are going to do so.

Yes. Sgt. Bergdahl is currently assigned to administrative desk duty at Ft. Sam Houston pending completion of the investigation. We all have to keep in mind that Bergdahl is innocent until proven guilty. The US military takes a dim view of desertion, so if it goes to Courts Marshal, he could face life at Leavenworth, or even a firing squad--it's still in the UCMJ.
President Obama admires Bowe Bergdahl and was willing to trade 5 Taliban leaders for this hero. National Security Adviser Susan Rice stated that Bergdahl "served the United States with honor and distinction" and that "Sergeant Bergdahl wasn't simply a hostage; he was an American prisoner of war captured on the battlefield." Certainly they will pardon him for any minor transgressions he may have committed. In Bergdahl's final e-mail to parents he wrote his parents: "The future is too good to waste on lies. And life is way too short to care for the damnation of others, as well as to spend it helping fools with their ideas that are wrong. I have seen their ideas and I am ashamed to even be american... I am sorry for everything. The horror that is america is disgusting..." Obama shares these sentiments and has great respect for this hero and has worked to change U.S. policy in the Middle East to better align with the Islamists. President Obama will likely award Bowe Bergdahl a Medal of Honor during his final year in office.
