Impartial person chosen by the parties to solve a dispute between them. An arbitrator is empowered to make a final determination concerning the issue(s) in controversy and is bound only by his own Discretion. See also Arbitration.

Law Dictionary: Arbitrator

An impartial person chosen by the parties to solve a dispute between them, who is vested with the power to make a final determination concerning the issues in controversy. 58 U.S. 344, 349. The decision of the arbitrator (the counterpart of a court's order or judgment) is called the award. A court order enforcing an arbitrator's award is called confirmation.

In the past, agreements to submit disputes to arbitration were held void as infringing on court jurisdiction. Early in this century, courts and legislatures began to recognize and enforce such agreements. Arbitration is common in commercial disputes, labor management relations, and, recently, in uninsured motorist and no-fault insurance plans.

Arbitrators are bound only by their own discretion, exercised within the scope of the authority entrusted to them by the parties rather than rules of law, equity, procedure, or evidence.

Many states have adopted rules or statutes, based on the Uniform Arbitration Act, which govern the enforcement of arbitration awards. Compare arbiter; conciliator; mediator.
