  1. Failure to perform a task or fulfill an obligation, especially failure to meet a financial obligation: in default on a loan.
  2. Law. Failure to make a required court appearance.
  3. The failure of one or more competitors or teams to participate in a contest: won the championship by default.
    1. Computer Science. A particular setting or value for a variable that is assigned automatically by an operating system and remains in effect unless canceled or overridden by the operator: changed the default for the font in the word processing program.
    2. A situation or condition that obtains in the absence of active intervention.

The current setting or action taken by hardware or software if the user has not specified otherwise. Application programs have numerous defaults that determine everything from the font size that should be used to the folder a file is saved in. A default also implies that the setting or action can be changed.

The term is also a verb. For example, in the expression "the program defaults to xxx," it means that the program does xxx under these circumstances unless directed to do otherwise.

Failure to meet a contractual obligation, such as repayment of a loan by a borrower or payment of interest to bond holders. Default gives the note holder, or the holder of a mortgage bond, rights and recourse under the mortgage indenture to institute foreclosure proceedings or to accelerate the maturity date.

 

Failure to fulfill an obligation or promise, or to perform specified acts.
Example: The Contract required the buyer to close within 3 business days. His failure to appear at Closing constituted a default under the contract.

An omission; a failure to do that which is anticipated, expected, or required in a given situation.

Default is distinguishable from negligence in that it does not involve carelessness or imprudence with respect to the discharge of a duty or obligation but rather the intentional omission or nonperformance of a duty.

To default on a debt is to fail to pay it upon its due date. Default in contract law implies failure to perform a contractual obligation.

A default judgment is one that may be entered against a party in a lawsuit for failure to comply with a procedural step in the suit, such as failure to file an answer to a complaint or failure to file a paper on time. A default judgment is not one that goes to the merits of a lawsuit but is procedural in nature.

In law, a default is the failure to do something required by law or to appear at a required time in legal proceedings.

In the United States, for example, when a party has failed to file meaningful response to pleadings within the time allowed, with the result that only one side of a controversy has been presented to the court, the party who has pleaded a claim for relief and received no response may request entry of default. In some jurisdictions the court may proceed to enter judgment immediately: others require that the plaintiff file a notice of intent to take the default judgment and serve it on the unresponsive party. If this notice is not opposed, or no adequate justification for the delay or lack of response is presented, then the plaintiff is entitled to judgment in his favor. Such a judgment is referred to as a "default judgment" and, unless otherwise ordered, has the same effect as a judgment entered in a contested case.

It is possible to vacate or remove the default judgment, depending on the particular state's law.

Entry of default in the United States district courts is governed by Rule 55 of the Federal Rules of Civil Procedure.
