Involving a mistake; signifies a deviation from the requirements of the law. 15 F. 2d 285. It does not connote a lack of legal authority, and is thus distinguished from “illegal.” See 23 P. 508. “It means having the power to act, but [committing] error in its exercise.” 15 F. 2d 285, 286.
