A hardship discharge is a discharge that lets you stop making payments early if you are unable to complete making payments. If a Chapter 7 does not work for you, it is likely a hardship discharge would not work for you either. Removal of your name from the property could look suspicious. That leaves the option of dismissing and refiling a Chapter 13, but I cannot recommend this as I am a paralegal, and you should discuss this with an attorney who is familiar with your case and finances. That person would be to thoroughly examine your files and see if it will work for you.

What do you need for an adversary proceeding to discharge student loans for hardship reasons?

'Undue hardship' dismissals of student loan(s) decisions are generally based on criteria of the U.S. Court of Appeals 2nd Circuit, Marie Brunner, Appellant vs. N.Y. State H.E.S.C. Very seldom will a lower court allow the discharge of student loans. The exception could be,a disability which will not allow the loan holder to ever earn/have sufficient income for repayment.

I cosigned for a private student loan and then two years later she filed for bankrupcty and has been discharged now it is my responsiblity how can I get out of it if she was discharged?

You might want to make sure the student loan was discharged. Most cannot be without a showing of a hardship, and the mere inability to pay is not a hardship. If it was discharged, you must pay, but if she could get a discharge, you should be able to.

When is astudent loan forgiven?

A law was passed in 1998 that has made it even more difficult to discharge a student loan in bankruptcy. It is incredibly difficult to discharge a loan in this way, and the only approach is to convince a court that repaying the loan would create a severe hardship for you. Otherwise there are options to research into getting your loan payments postponed and/or deferred.
