Not neccesarily if they are cold they tend to get hard. If they are stale they get hard too. If the gummy bears are normal temperature and hard they are probably stale.
Stale wouldn't be the word I would use. They tend to go hard, the moisture is evaporated out of them and they loose their trademark 'gumminess.'
