Honestly it's a bit of a grey area. If it is on your own land, no. If it's on private land and you have permission, no.
If it's on Public land and you don't have the relevant permits... Yes.
If you are an adult you will almost certainly be moved and you risk a fine.
If you are a child you still might get moved but nothing more. No self-respecting local authority will punish a child, but they may (quite rightly) ask you to move on.

If you don't have permits and other business papers then by law it is illegal. However usually, if it is a little kid lemonade stand then the police won't mind, but lawfully, it is illegal.

Unfortunately yes you do, however, the majority of law enforcement has larger problems to deal with so rarely enforce laws on lemonade stands.
Ask your parents if you can get an allowance for chores, etc. and if not offer to mow your neighbor's lawns. Or you could have a garage sale and a lemonade stand, lemonade stands are cheesy, but they work.
