This must surely depend upon your definition of what it means to be human. A sociopath is still human, but one without remorse or grief, they manipulate and control, and are unlikely to change. It may be hard to understand the mind of the sociopath, as most 'normal' people will be relatively unable to turn off their conscience, however these people deserve understanding as much as any other person, and once you understand them it might perhaps be easier to guard yourself against them. Yes, they are human. With regards to the soul, surely everybody has a soul? If you believe in such things then we must all be born with them, including sociopaths. Maybe their lack of empathy would cause their soul to be stunted. I think that, in the case of this question, you should be more specific in regards to the definition of the soul. Perhaps you see (or indeed, do not see) a difference in being 'human' and being 'humane'.
