Yes, TTDS / R4DS are illegal, but ONLY if you use them for "ROM"s. You can apparently use them for other kinds of media, like music.

Hi, I'm Oliver and I come from Germany. In my oppinion the TTDS is at present not illegal. Only the download of the games (.nds) are not allowed. (You can become them from friends or other person...) Chips like M3 are not good for Nintendo, because they have video and picture functions. This functions are very risky fore the sale of DSi. When you will have pictures on the TTDS, you must download illegal programms, so the TTDS isn't very interesting for Nintendo. At present they will forbid the M3...
