The Department of Game and Inland Fisheries just told me you can not have a Capybara, but I can't find any statute that supports their answer nor were they able to provide one.
The pet laws in Virginia seem to be very subjective, almost to the point where regardless of the actual law I would fear for the safety of any exotic pet discovered by animal control authorities. Even some of the animals on the list of "Domestic Animals" provided in Virginia statute will be confiscated and likely killed if discovered, such as the domestic fox.
