I have just looked this up and apparently by law, Employers only have to provide a break every 6 hours, which is usually done as a lunch break. So they do not HAVE to give a smoke break. You work 5 hours a week and expect a break!
If someone works for 6 or 6.5 hours, they are not entitled to a 30 minute break. They are entitled to a 30 minute break if they work 8 hours or more.

This probably depends on your state, company size and whether you're in a union, but I believe by federal rules that if you work 4 hours straight you're entitled to a 15-minute break. This usually results in two 15-minute breaks a day.

Did you break it at work? If not, no. You take your short term disability / or PTO time - check and see how / when this 'kicks' in. Usually you have to be out a full week before it applies. Hopefully you have that much PTO/vacation time to apply to it before you can get your short-term activitated.
