The best ... and only ... advice we can give here on this is "contact an attorney." The procedure is going to depend on the jurisdiction, and you're almost certainly going to need an attorney before this gets resolved anyway. If the administrator (do you mean executor?) is a family member or friend you might talk to them first; you might be able to resolve this amicably (maybe there are very good reasons for what you perceive from the outside as "bleeding the estate dry"). If not, it's lawyer time.
Not necessarily. However, it is a good idea to consult a lawyer when dealing with such an issue. If your employer is going to give you trouble, or the state does not want to pay, it is best to resort to using a lawyer. Having a lawyer to consult to about a disability retirement is not a bad idea. State law may require that a person is disabled for a minimum of two years before being considered for benefits.

Yes, Cortes was educated as a lawyer, owned a farm and worked as soldier before going on his voyages.
A creditor might be able to assert some sort of claim to the portion of the estate going to the heir if the Administrator is served with notice of a judgment. Remember, the Administrator is wholly responsible for every dime spent and is also accountable for their actions regarding paying debts.
Well if you need to hire a lawyer then you obviously want to hire a good one. So choosing the good one compared to the not so good one makes sense. If it's your first time hiring a lawyer your going to go for the first one you come across that you feel comfortable with hiring. Or if you've used the same lawyer a few times they have obviously done good work for you before
