Treaty of Guadalupe Hidalgo
Baja California was never taken from Mexico. The territory that was lost however, included California. The Treaty of Guadalupe Hidalgo designated which extension of territory was given to the US after the Mexican-American War (1846-1848).
The affected states were Texas and California. Texas gave up claims in the New Mexico Territory, and California (undivided) was admitted as the 31st state, and one where slavery was not allowed.

Mexico gave the United States upper California and New Mexico, Mexico agreed that the border between Mexico and America was the Rio Grande, and the US gave Mexico $15 million.
In the Compromise of 1850, the Mexican Cession territory (excluding California) was to become New Mexico and Utah. Their slave situations were to be determined using popular sovereignty, or the power of the votes of the people to decide if it would be a slave state or not. In addition, the Compromise of 1850 also gave the disputed territory between Texas, a slave state, and New Mexico to New Mexico. This invalidated the previous compromise, the Missouri Compromise, which banned slavery in North of 36 in newly gained territory.

The US state of New Mexico, is indeed a state and not a territory. It has an eastern border with Texas and a western border with Arizona. It also has a problematic border with the nation of Mexico. The land New Mexico in located on was first claimed by Spain in her early days of exploration in what can now be called the southwestern part of the US. Later, Mexico's independence from Spain, gave it the same territories Spain once controlled. The result of the 1846 Mexican War, gave this area as a cession from Mexico to the US. All in all, this territory had four "claims" of ownership:1. American Native Tribes 2. Spain 3. Mexico, and 4. the US.
