You can marry anyone you want as long as you aren't all ready married. Bad credit is not a reason for the government to stop a marriage. "No papers " is more important. When getting a marriage license usually Identification is needed by the county clerk.

Marrying him allows him to stay. You'll have to find a state that allows same sex marriage. I dont believe there is anything special that needs to be done for a cuban.
