Unfortunately, if the child is under 18, they are a minor, period. That's the national rule. If you are caught or engage in sexual acts, the parents or the 16 year old can chose to press charges, in which the 30 year old will be labeled a sex offender. If you are together as a couple, but do not engage in sex until the child is 18, then I don't believe that is illegal.
