If your debt is not included in the credit bureau can you be sued by the debtholder?

A debt does not have to be reported to a credit bureau in order for the business to pursue collections, sue or place the account with a collection agency. If a debt is owed, it can be collected by phone calls, letters, personal visits or through the court system.

Can a collection agency legally demand you tell them where you are getting the money to pay off your debt?

Absolutely not. A collection agency can only demand payment of you. If you think the collection agency with which you're dealing is acting unethically, you should check out the Fair Debt Collection Act. You can file a formal complaint and the agency can be fined. * Legally they cannot "demand" anything, they can request, they can debate, they can negotiate, assuming the debtor wants to spend the time engaging in such, but they cannot "demand". The debtor always has the option of hanging up the phone and refusing to communicate with a collector or creditor, as there is no U.S. law that requires the debtor to do accept nor particpate in collection calls.

You just received a notice on a credit card indicating that it was in the process of being charged off and was urged to make payment arrangements-- What exactly does this mean?

Within a 180 days of default a creditor must charge off the account. After which the account is sent to a collections agency who then follows established collection procedures. These are generally implemented in the form of letters and/or phone calls to the debtor. Collection agencies are obligated to conform to FDCPA regulations whereas original creditors are not. If suitable payment arrangements are not made, the agency that "buys" the account may decide to pursue legal alternatives.

Can a debt collection agency call your work?

No. Once the party involved has informed the collector that they do not want them calling their place of employment the calls must end. Some collectors however simply will not listen and continue to break FDCPA laws. If this is the case the collection agency should be reported to the office of the state's Attorney General. This can be done by phone, but it is best to follow up in a letter. Keep a log of any calls received after the request has been made.

How can you stop calls from a collection agency?

To stop calls from a collection agency, you need to write them a letter. In this letter, you should tell them to cease and desist further communication with you. Send the letter by registered mail so that you have proof you sent it. Also, when mailing the letter, ask for proof of delivery. Why would a collection agency suddenly stop calling?

It is important to pay bills on time, every month. A collection agency calls to help a person with their finances and with paying their past-due bill, they stop calling when it is obvious they are not getting what they need, and they need to send it to a persons credit.?æ
