As far as I know-the answer is NO. They gave up that right when convicted of a felony. And I do believe they can never own one again legally regardless of what type of crime it was.
Added; In some states you can petition the state to have SOME of your firearm possesion rights restored if you were convicted of certain STATE offenses, but the state MUST grant that right to you.
As far as Federal Felony convictees are concerned, they may NEVER own or possess a firearm again, and the penalty for possession is up to a maximum of 15 years in prison.
YES...
I am an ex-felon.
Charged, Convicted and Sentenced in California with 9 counts of Grand Theft (487.1) and Possession of Stolen Goods (496) about 22 years ago. Did 9 months of the 1 year charge. 3 years of felony probation.
Several years ago I purchased a pistol. Obtained a California Guard Card, Baton, Chemical, First Aid and an Exposed Weapon Permit.
Recently my ex-wife got upset, called the police and said I was an ex-felon with a firearm. They booked me... I showed my documentation, they released me, the District Attorney verified my information and now I'm typing this for all to read...
The facts - Can a felon own a firearm? the answer is NO.
So what you need to do is remove the felony from your record just like I did.
1. Get your RAP Sheet from the Sherrif's Department where you were booked ($25)
2. Go to the Superior Courthouse and obtain and file the forms PC 1203.4 and PC 17 (b) - ($240)
3. Appear in court when you get your letter.
NOTE: The PC 17 (b) is key. Not all states offer it. Read the rules about those whom can file and the wait time is 2 years after your crime and restituion.
